Windows Vista faces possible trademark challenges

Microsoft, the world’s largest software company, announced the name of its forthcoming version of the Windows operating system from its headquarters in Redmond, Washington Friday. But in choosing the name “Vista,” Microsoft may find itself in a legal fight.

Microsoft has made a name for itself in legal circles as a company that fiercely defends its trademarks and other intellectual property. With the choice of “Vista,” the tables may turn as it may face allegations of swiping another company’s trademark.

It appears the Vista name has already been taken by another high-tech company, coincidentally also based in Redmond. A few miles from the sprawling Microsoft campus is Vista Incorporated, which has operated a small business internet interchange since it was founded by Wall Data founder, John Wall in 2000. He was surprised by his larger neighbor’s move.

“We are going to consider our options and talk to Microsoft,” Wall said in an interview with the Seattle Times. Wall reportedly has not yet filed suit against Microsoft to stop it from using the “Vista” name. An investor in SCO, he does have other legal options aside from law suits. Instead, he may offer to sell the rights to the “Vista” name.

However, John Wall’s company is not the only business with claims on the name “Vista.” Many other tech companies use “Vista” as product names. Additionally, a wide-range of non-computer businesses have the name reserved, including branded products for sewing machines, elevators and the dairy industry.

BC design club president comments on Olympic mascots; sales brisk

Wikinews recently spoke with Mark Busse, president of the BC Chapter of the Society of Graphic Designers of Canada, to find out what his organization’s views are of the 2010 Winter Olympic and Paralympic mascots, Miga, Quatchi, and Sumi.

Many people love them. Obviously some don’t. Kids seem to adore them. But as a professional designer, I am trying to keep an open mind and try to consider the big picture and audience before judging them too quickly.

The mascot design was a very difficult problem for the VANOC 2010 planning committee — and a very important project with lots at stake. Unlike during the original logo competition, VANOC chose to not engage in an open, speculative contest, but rather came to the Society of Graphic Designers for assistance and guidance, followed our recommendations and engaged in a thorough, thoughtful, fair and comprehensive design competition and process. They had our full cooperation and support and we encouraged all GDC members to participate.

I would have likely designed something different, although I had suggested using BC mythology, such as a Sasquatch, to capture the imagination of a predominantly young international audience. But I think the result of VANOC’s careful design process is a solution that captured BC’s spirit, culture, attitude, geography, wildlife, athleticism — even mythology — in a clever and friendly way. Quatchi, Miga and Sumi are respectful of BC aboriginal heritage without alienating all Canadians.

While the products at HBC stores of the mascots have been flying off the shelves, many have bashed the designs for having “too much” of a Japanese influence. As of 2001, 1.5% of Vancouverites were Japanese heritage, and 29.9% were of Chinese descent. Vancouver’s Chinatown is one of the largest historic Chinatowns in North America, and Japan has had diplomatic relations with the city since 1930.

This is the first time the Olympic and Paralympic mascots have been unveiled at the same time.

Busse is also a partner and the design director at Industrial Brand Creative, a design firm in the province. He is co-chair of Graphex ’08, a design exhibition at the Emily Carr Institute, which “showcases the best cultural, social and business communications in Canada.”

Australian government provides $15.8 million for North Adelaide Technical College

Australian Minister for Vocational Education and Training, Gary Hardgrave has announced the government will provide AU$15.8 million to establish an Australian Technical College in North Adelaide. The minister said the government was entering into a partnership with the Archdiocese of Adelaide and consortium of industrial and manufacturing companies.

The North Adelaide college will be located in Elizabeth and be operated as an independent non-government school. The college is one of 25 to be established across the country.

Enrolments at the college will begin in 2007 and will offer courses in areas where identified skills shortages exist in the North Adelaide region, specifically – engineering, construction, electronics and cooking.

Mr Hardgrave said that the proposed college had been popular among the North Adelaide business community. “This important initiative has been well received by North Adelaide business and industry, and will help to address skills needs and provide opportunities for those in greatest need, including a lot of Indigenous students in the region,” Mr Hardgrave said.

“The fact that this College is being led by local employers, local government and other key stakeholders, means it will be truly industry and community driven,” he said.

Australian Technical Colleges were established to cater for year 11 and 12 students who wish to do an apprenticeship as part of their school education.

The Australian Education Union has expressed a number of concerns about the model put forward by the government. In a report, they claim that trade facilities at TAFE colleges (operated by state governments) will deteriorate as funding is diverted to the ATCs. The union is also concerned that ATCs are supposed to be selective VET schools. According to the union they will have selective entry and preferential funding. It is feared that teachers will be lured away from schools and TAFE colleges to higher paid positions in ATCs.

The Education Union suggested that the government invest in schools that already offer vocational education programs.

Horse racing in NSW, Queensland cancelled indefinitely

Thoroughbred horse racing has been cancelled indefinitely in the Australian states of New South Wales and Queensland due to an outbreak of Equine Influenza. An Australia-wide ban on the movement of horses, donkeys and mules which was due to expire on Wednesday has been extended until Friday. NSW and Queensland have extended their bans indefinitely.

So far the virus only appears to have infected horses in NSW and Queensland, with 51 confirmed cases and another 400 suspected. So far all those infected appear to be horses used for recreational purposes and not thoroughbred race horses.

Despite the bans on racing and horse movements, track work will recommence in NSW and Queensland today.

It had been feared yesterday that four race horses at Randwick Racecourse in Sydney had been struck down by the virus, but the horses later tested negative to the virus. If an outbreak were to occur at Randwick it could affect up to 700 race horses stabled there.

The outbreak comes at a bad time for the industry, as it prepares for the lucrative spring racing season in Sydney and Melbourne. The AUD$1 million Golden Rose event at Rosehill has been cancelled, although it is expected that Melbourne’s spring racing carnival will resume on Saturday as no cases of the flu have been seen in Victoria.

Racing Victoria has also said the Melbourne Cup will go ahead as planned despite the outbreak, even if no interstate or international horses can attend.

Despite fines of up to $44,000 and 12 months imprisonment in NSW there have been reports that more than 100 horse owners have been caught moving their horses. The NSW Primary Industries Minister Ian Macdonald, said it was “absolutely vital that no-one moves a horse in this state”.

“We will be working with police to ensure horses are at a standstill,” he said.

The racing bans have cost gaming companies Tabcorp and Tattersall’s millions, with Tabcorp losing $65 million in revenue on the weekend. Tabcorp expects to lose around $150 million in turnover this week. Tattersall’s has also said it expects to lose around $2 million in revenue per week due to the outbreak. Investors reacted to the news, slashing 3 percent of the price of Tattersall’s shares and over 4 percent of those of Tabcorp.

In February 2017, the Iranian Chess Federation announced two teenage chess players, Dorsa Derakhshani and her younger brother Borna Derakhshani, were banned from representing the national team. The federation announced their decision although Dorsa Derakhshani had previously decided and informed the chess federation she did not wish to play for Iran.

Dorsa Derakhshani is currently 21 years old and holds the International Master (IM) as well as Woman Grand Master (WGM) titles. Her brother, Borna, plays for the English Federation and holds the FIDE Master title.

Dorsa Derakhshani was banned since she did not wear a hijab, an Islamic headscarf, while competing at the Tradewise Gibraltar Chess Festival in January 2017. Under the laws of Islamic Republic of Iran, hijab is a mandatory dress code. Her brother Borna Deraskhsani was banned for playing against Israeli Grand Master (GM) Alexander Huzman at the same tournament. Iran does not recognise the existence of Israel, and previously, Irani athletes have avoided playing against Israeli athletes.

Pentagon’s Quadrennial Defense Review released

The Pentagon released its findings from its Quadrennial Defense Review today. This review focuses mainly on defining and identifying weak points in United States defenses, and prescriptions for improvements in those areas.

This review, known as the Quadrennial Defense Review because Congress requires it every four years, does not alter the Pentagon’s approach in Iraq. It also leaves intact the Defense Department’s broader strategy for keeping the U.S. military big enough to fight other major conflicts.

The plan proposes a 4.8% boost to the Department of Defense budget, eliminates no major weapons programs and includes an 8 percent overall increase for weapons (to US$84 billion) for the budget year starting Sept. 30. This review excludes the Energy Department’s nuclear weapons programs.

Overall, there was an emphasis on finding ways to adopt a more indirect approach to the war on terror; a shifted emphasis from performing tasks to enabling other countries to perform. Some of the specific proposals include:

  • Expansion of special operations forces by 15%; the Army’s Green Berets and the Navy SEAL commandos, for example, who are trained in specialized warfare skills that are often utilized covertly in cooperation with the armed forces of small countries.
Relevant to this expansion, the Marines are establishing a special operations force for the first time, with an initial goal of preparing 2,600 Marines.
  • An increase by 3,700 (or about one-third) of psychological warfare and civil affairs units. These are in heavy demand in Iraq and Afghanistan because of their role working with local civilian authorities to build trust and influence perceptions of U.S. forces.
  • Building new partnerships in the “War on Terror” by increasing time spent training other armies, navies and air forces, particularly in places, where U.S. troops have not traditionally operated. This in turn, will call for an increased mastery of other languages and better knowledge of foreign cultures.
  • More officers serving stints in foreign militaries to better develop long-term relationships and regional expertise.
  • The creation by the Navy, of a force of small boats that can be utilized in inland waterways abroad to help countries build their own maritime forces to combat terrorists.

Other highlights include:

  • A proposed 10 percent reduction in the fleet of Minuteman III land-based nuclear missiles, from 500 to 450 missiles. Also, the conversion of some nuclear missiles on Trident submarines to non-nuclear missiles within two years. The Pentagon did not specifically state how many are to be converted.
  • A five-year, $1.5 billion program to develop medical countermeasures for bioterrorism threats.

Australia Votes 2007: Labor plan for home buyers

Kevin Rudd, Australia’s Leader of the Opposition has promised a special home buyers’ bank account with tax concessions if Labor is elected on November 24.

Mr Rudd says AU$64,000 could be saved by a couple on the average wage over five years. The plan would cost the Government $600 million dollars.

The Housing Industry Association has welcomed the announcement but says it would be a start and would “avoid a stampede of first home buyers into the market.”

Prime Minister John Howard is bracing himself for a possible Wednesday interest rate rise which may decide the election. Howard has defended the rumours, saying that some rise would be ‘unavoidable’.

A state of emergency was declared Sunday for the U.S. state of Washington by governor Christine Gregoire, as additional reports of storm-related casualties surfaced. The state National Guard has been deployed to aid in distributing supplies.

Thousands were still without power in the coastal and Puget Sound regions, though most urban areas were back with power as late as Sunday afternoon, and outages were mostly contained to rural and unincorporated areas. Puget Sound Energy reported that roughly 500,000 energy customers out of the 700,000 who lost power were back in service by Sunday evening. Seattle City Light, the city’s independent municipal utility, reported only 18,000 customers still without power as of Monday morning, down from a peak of 175,000.

Four additional deaths related to the post-storm power outage had been reported as of Monday, bringing the total number of casualties to eight. A man in Gig Harbor was electrocuted by a downed power line while walking his dog. Another man in Spanaway died when an unattended candle caused a house fire.

Two died from carbon monoxide poisoning in separate incidents related to use of combustion devices indoors. Roughly a hundred additional cases of non-fatal carbon monoxide poisoning were reported from people using generators or grills indoors. News radio stations and authorities warned the public to stay away from downed power lines and not to use grills indoors. Dr. Neil Hampson at Virginia Mason’s hyperbaric unit, where a number of victims were being treated, warned it could be “the worse case of carbon monoxide poisioning in the country”.

On Monday, four new carbon-monoxide deaths were reported in a family of five in Burien due to an indoor generator. In Canada, which had some damage from the week’s storms, two southern British Columbia carbon monoxide deaths were also reported. Despite continued warnings, hospitals are still seeing cases of carbon monoxide poisoning, including a family in w:Shoreline, Washington which was taken to the hospital after they reported symptoms due to their indoor grill. Neighbors of the Burien family suggested that noise concerns are leading people to place noisy generators indoors.

The massive power outage left many stores and gas stations unable to operate. Some businesses opened with the help of backup generators, conserving power by foregoing heat and refrigeration, exterior lighting, and half the interior lighting. Most stores had run out of “D” size batteries, the most common size for flashlights, as well as firelogs and other essentials. Gasoline shortages were reported throughout the area, with one man selling excess fuel for as high as $15 per gallon, over 5 times the average retail price.

The Red Cross set up shelters throughout King and other affected counties for those without power or food. Hotels reported no vacancies as whole families took shelter in powered hotels, especially in Seattle. Restaurants also reported brisk business as people sought out a hot cooked meal. Tons of perishable food were expected to have become unsafe after the prolonged outage disabled refrigerators and freezers both in homes and stores.

Many of those without power visited nearby friends and family living where power had been continued or restored, while others traveled out of the area to places that had not been affected. The widespread outage made long-distance traveling treacherous on some major routes, with roadway lighting, cellular towers, and services disabled by the outage.

Most major roadways which were closed during the storm were reopened on Friday. The 520 Floating Bridge over Lake Washington, a major conduit to the technology-rich Eastside, sustained minor damage. Amtrak, which had halted its Cascades service, resumed Saturday evening. Sea-Tac Airport resumed operations with a reduced flight load, after a transient power outage on Friday disabled the airport radar and caused all planes to be grounded until it was repaired.
